The Last Will and Testament of Samuel Coe

August 31, 1863

 

 

     I, Samuel Coe, of the town & County of Madison and State of New York, being of sound mind and memory do make & ordain this my last Will & Testament in manner and form following, viz:

     First.  I give and bequeath to my daughter Loretta Hutchinson, my house & lot in Madison Village, which I now own.

     Second.  I give and bequeath to my daughter, Electa Browne one thousand dollars, said bequest to include the sum of three hundred dollars hereinafter mentions as coming from Adin C. Howard.

     Third.  I give and bequeath my cow to the wife of Adin C. Howard.

     Fourth.  I give and bequeath to the American Baptist Free Missionary Society one hundred dollars.

     Fifth.  My farm in Augusta for which I paid eleven hundred dollars, and which I purchased for the benefit of my adopted son, Adin C. Howard, I dispose of as follows, viz:  To the said Howard, I give and bequeath an interest in said farm of four hundred dollars.  Said Howard shall occupy said farm, and it shall be a home for himself and his family and they shall possess and enjoy all the benefits, privileges, improvements and appurtenances accruing from said occupancy.  After my decease the said Howard shall pay to my daughters Loretta and Electa aforesaid, or their heirs, annually the interest accruing in six hundred dollars to be equally divided between them, and the said Howard may at any time he chooses pay the said Loretta and Electa each or either of them three hundred dollars, and then cancel their claim on the premises.

     The bequest to the American Baptist Free Missionary Society shall be a charge on said farm, and the said Howard shall either pay the one hundred dollars aforesaid to the said Society on my decease, or the interest accruing thereon yearly.  And if the said Howard from improvidence or misfortune fails to make the several payments above described, he may sell a portion or surety of said farm sufficient to liquidate and cancel the claim above indicated.

     Sixth.  If any personal property remains after paying the bequests herein granted, it shall be equally divided between my two daughters Loretta and Electa aforesaid share and share alike and if from any cause a deficiency occur and these hall not be property enough to pay all these bequests, then a deduction shall be made from them severally in pro rata funds sufficient to meet the exigency.

     Seventh.  I do hereby nominate and appoint John S. Lucas of Madison aforesaid to be the executor of this my a Will and Testament, hereby evoking all former wills by me made.  The inserting of the words "them severally" was made before sealing and signing of this instrument.

     In issues whereof I have hereinto set my hand and seal and do publish and declare this to be my last Will and Testament in presence of the witnesses named below, this thirty first day of August in the year of our Lord one thousand eight hundred and sixty three.
